We use the paid Gemini Developer API in a Shopify product configurator.
Our products are made for children, but the store, configurator and checkout are intended to be used by adults such as parents or grandparents. Children may be shown in uploaded photos, but they are not the intended users of the AI functionality.
The current Gemini API terms state that the API may not be used as part of an API Client that is directed towards or likely to be accessed by individuals under 18.
Would this use case be permitted if the AI-powered customization is intended to be used exclusively by adult purchasers?
We would appreciate clarification before launch.
Hello @Oskartix ,
Please refer Age Requirements page under Gemini API Additional Terms of Service documentation for more details.
Thank you for the reply.
I have reviewed the Age Requirements section, but I am still unsure how “likely to be accessed by individuals under 18” applies to our specific use case.
We operate a small online shop selling harmless personalized children’s products, such as personalized children’s books and related printed products.
The products are purchased and configured by adults, typically parents or grandparents. As part of the personalization process, the adult purchaser may upload a photo of their own child.
Gemini is only used in a very limited way to create an optional stylized or illustrated version of that uploaded photo for the printed product. There is no chatbot, no open-ended AI interface, no prompt input for children and no general AI tool exposed to the customer.
Children are the subjects of the personalized products and may appear in the uploaded photos, but they are not the intended users of the AI functionality.
Our goal is not to create a service for minors, but to allow adult purchasers to create personalized children’s products.
Would this type of use be permitted under the Gemini API Age Requirements without introducing a general 18+ age gate for the entire shop or configurator?
We would appreciate clarification on whether the intended audience and the limited nature of the AI functionality are sufficient in this case.
