Hello,
We would appreciate clarification on the “Age Requirements” section of the Gemini API Additional Terms before launching our application.
We are developing a commercial assistant that uses the paid Gemini Developer API to respond to incoming messages on a business Instagram account, answer questions about services, qualify prospective customers, and offer appointments.
The business owners and administrators are adults, and the services are intended for adult customers. However, the Instagram account is publicly accessible, so someone under 18 could message the assistant.
Our planned safeguards are:
-
Clearly identifying the assistant as AI.
-
When a user explicitly states that they are under 18, blocking further Gemini calls and pausing automated responses.
-
Sending any age-related notice as a fixed message without using Gemini.
We do not currently verify age before the first Gemini call. We understand that pausing after an age disclosure may not satisfy the requirement concerning API Clients “likely to be accessed by individuals under the age of 18.”
Could you clarify whether this use case is permitted? If additional controls are required, what measures would be sufficient before allowing access to the Gemini-powered functionality? In particular, would an explicit confirmation of adulthood before any Gemini call be sufficient, or would stronger age verification be required?
If this forum cannot provide an authoritative clarification, could you direct us to the appropriate Google team or support channel?
We want to understand and meet the requirements before launch rather than assume that an adult target audience alone is sufficient.
Thank you.
