Data Privacy on AI Studio's Paid Plans [IMPORTANT]

I am writing to inquire about the use of prompts and data for training purposes while using a paid plan on AI Studio, specifically the tier 1 plan. I would like to know if my prompts and data will be used for training even when on a paid plan.

Welcome to forum, for paid users:

When you use Paid Services, including, for example, the paid quota of the Gemini API, Google doesn’t use your prompts (including associated system instructions, cached content, and files such as images, videos, or documents) or responses to improve our products, and will process your prompts and responses in accordance with the Data Processing Addendum for Products Where Google is a Data Processor. For Paid Services, Google logs prompts and responses for a limited period of time, solely for the purpose of detecting violations of the Prohibited Use Policy and any required legal or regulatory disclosures. This data may be stored transiently or cached in any country in which Google or its agents maintain facilities.

When a Service is being offered for a fee, it is considered to be a paid Service (the "Paid Services "). When you activate a Cloud Billing account, all use of Gemini API and Google AI Studio is a ā€œPaid Serviceā€ with respect to how Google Uses Your Data, even when using Services that are offered free of charge, such as Google AI Studio and unpaid quota of Gemini API.

So it sounds like it is possible to use Google AI Studio with confidential data. HOWEVER, it is unclear to me exactly how this is accomplished. My organization has a cloud billing account, so perhaps because I am logged in to Google AI Studio with the Google account that I use in the cloud console that means my usage of Google AI Studio is as a paid service. However, I wasn’t able to find any confirmation that this is the case in the Google AI Studio UI.

Can anyone confirm exactly how to confirm that I have done the ā€œwhen you activate a Cloud Billing accountā€ step and Google AI Studio is operating as a paid service? Thanks!

Hi @ForrestTrepte,

If I am not mistaken, in the Settings tab of AI Studio it has API Plan information and in that we can see the tier of the plan we are in and the billing account attached it. From there we can see the usage of paid api calls. Hope this helps. It looks like this.

Thanks @Siva_Sravana_Kumar_N! I see that information and it confirms that I’m using a paid plan.

Actually, looking more carefully now I’m not so sure. On the API Plan Billing information I see:

  1. ā€œYou can upgrade to a paid plan by enabling Billing in your Google Cloud Project associated with your API key.ā€ This suggests that I am not currently on a paid plan and I would need to upgrade.
  2. The name of my Google cloud project and it’s plan, displayed as Tier 1 with a ā€˜Go to billing’ link that links to my paid billing account information. This suggests that I do have a paid plan. But it’s linked to my Google cloud project and I’m not sure that my Google cloud project is used when I’m using Google AI Studio.
  3. A ’ Billed model pricing for the API’ dropdown with the different models. Below that dropdown, pricing information shows ā€˜DATA USED TO IMPROVE OUR PRODUCT’ as Yes for free of charge and No for pay-as-you-go. Google AI Studio is free of charge, so this suggests that my data can be used.

So, I’m not confident in using Google AI Studio for confidential data.

Regardless of whether you have a paid API account, if you use the AI Studio interface, your data may be used for model training.

Using the AI Studio interface is considered a free service, and therefore data sent to Studio can be used to train the model.

Using the Gemini API is where billing occurs.
Data usage policies for the API are different from the AI Studio interface. For detailed information on data usage with the paid API, it is essential to refer to the Google AI terms of service.

And for all experimental model usage your data will be used for training.

But it is unclear to me how to confirm that I am using Google AI Studio as a paid service.

The difficulty in establishing that you are using AI Studio as a paid service stems from… you are using AI Studio for free. There is no pay-as-you-go option for AI Studio. See Data privacy in use Google AI Studio - #2 by OrangiaNebula for a recommended approach if you wish to avoid having your proprietary data used in training the next model generation.

This seems to add some clarity
(quoted from Billing  |  Gemini API  |  Google AI for Developers):

ā€œRefer to the [terms] for details on how data is handled when Cloud billing is enabled (see ā€˜How Google Uses Your Data’ under ā€˜Paid Services’). Note that your Google AI Studio prompts are treated under the same ā€˜Paid Services’ terms so long as at least 1 API project has billing enabled, which you can validate on the [Gemini API Key page] if you see any projects marked as ā€˜Paid’ under ā€˜Plan’.ā€
