Utilizing the OpenAI API to develop and deploy applications is currently not compliant with EU privacy regulations, particularly in Germany. Could you confirm whether the Google API meets the necessary legal requirements to enable the deployment of Gemini-based chatbots in Germany?
Welcome to the forum. This is from a developer, not a lawyer. The most relevant section, I believe, is Condiciones del Servicio Adicionales de la API de Gemini | Gemini API | Google AI for Developers . That covers API use. There is no paid tier for AI Studio use, therefore the recommendation is to only use publicly available data when designing prompts in Studio to comply with EU regulations.

However…
I’d point out that the free tier of AI Studio Gemini API does not meet EU privacy requirements and is not available in the EU.
My undesrstanding that the paid tier (both for the AI Studio Gemini API and Vertex AI Gemini API) does meet EU privacy requirements.
In addition, if you also have data residency requirements (ie - the data you’re working with must be stored or processed in a country or region), Vertex AI does have residency guarantees if you use the appropriate Google Cloud region.
