Can music generated with Lyria 3.5 (Gemini API / Gemini app) be distributed to streaming services through a distributor like DistroKid?

Hi,

I run a small music channel and create original songs with Lyria 3.5 — some through the paid Gemini API (lyria-3.5) and some in the Gemini app. I’d like to release a few of them on Spotify, Apple Music and YouTube Music through a distributor such as DistroKid. I would disclose AI use in the release credits and would not register the songs in YouTube Content ID.

DistroKid requires uploaders to “own 100% of the rights, including the legal right to distribute music created with any AI tools.”

I understand from the Gemini API Additional Terms that Google won’t claim ownership of generated content. However, I couldn’t find wording that explicitly covers distributing or selling generated music, and Section 5(e) of the Google APIs Terms of Service restricts distributing content returned from the APIs unless the owner permits it.

Could someone from Google clarify:

  1. Is distributing and monetizing Lyria 3.5 output from the paid Gemini API on streaming platforms permitted?
  2. Does the same apply to songs created in the Gemini app?
  3. Are there any Lyria-specific conditions we should follow (attribution, SynthID, prohibited uses)?

A similar question is still open here: Commercial use and YouTube publishing rights for Lyria 3.5 music generated via paid Gemini API

Thank you!

Hi @Lulletter,
If you have query with the Gemini application, I suggest filing a report directly through the Help section of the Gemini App. Navigate to Settings (gear icon in the bottom left) > Help > Help Center > Report a problem, and follow the prompts. Note that this forum is specifically for Google AI Studio and Gemini API inquiries.
