Terms clarification: offline Gemini API benchmarking for a public consumer website

Hello,

I am building an independent web game called HUMAN WINS?, where users answer reasoning questions and compare their results with previously recorded results from several AI models.

I would like clarification regarding the Gemini API Additional Terms, specifically the age requirement and the restriction on consumer use.

Our architecture is as follows:

  1. Gemini API is used only internally by the developer to run periodic offline benchmark evaluations.
  2. End users never send prompts, questions, personal data, or any other content to Gemini.
  3. End users never trigger a Gemini API request.
  4. The public website contains no Gemini API key or Gemini API integration.
  5. The website only displays previously recorded benchmark results, such as the score achieved by a specific Gemini model on a fixed question set.
  6. Gemini is evaluated alongside models from several other independent AI providers.
  7. The website is an independent project and does not claim affiliation with or endorsement by Google.

The public website itself may be accessible to users under 18, but those users do not interact with the Gemini API in any way.

Would this offline benchmarking and publication of previously recorded benchmark results cause the public website to be considered an “API Client” under the Gemini API Additional Terms?

In particular, would this architecture comply with:

  • the requirement not to use the Services as part of an API Client likely to be accessed by individuals under 18; and
  • the restriction stating that Gemini API is for professional or business purposes and not for consumer use?

If this use case is not permitted under the Gemini Developer API terms, would using Gemini through a Google Cloud / enterprise offering such as Vertex AI be the appropriate alternative for this type of independent benchmark?

Thank you.
